Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Goafie ("Goafie," "we," "us," or "our") and govern your access to and use of the Goafie mobile apps, websites, and related services (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old, and at least the minimum age of digital consent in your country, to use the Service. If you are under the age of majority where you live, you may use the Service only with the involvement of a parent or guardian who agrees to these Terms.
2. Your account
You can create an account using Sign in with Apple or Google. You are responsible for the information associated with your account, for keeping access to it secure, and for activity that happens under it. Provide accurate information and let us know promptly at support@goafie.com if you believe your account has been compromised.
3. License to use the Service
Subject to these Terms, we grant you a personal, limited, non‑exclusive, non‑transferable, and revocable license to use the Service for your own personal, non‑commercial use. We reserve all rights not expressly granted to you.
4. Acceptable use
When using the Service, you agree not to:
- break the law or infringe the rights of others;
- upload content that is unlawful, harmful, deceptive, or that you do not have the right to share;
- access accounts, data, or systems that are not yours, or attempt to defeat App Check or other security measures;
- reverse engineer, scrape, overload, disrupt, or interfere with the Service; or
- use the Service to build a competing product or to resell access without our written permission.
5. Your content
You keep ownership of the trips, photos, notes, and other content you add to Goafie ("Your Content"). You grant us a worldwide, non‑exclusive, royalty‑free license to host, store, reproduce, and display Your Content solely to operate, secure, and improve the Service and to provide the features you use, including sharing with people you choose. You are responsible for Your Content and confirm you have the rights needed to share it.
6. Sharing and social features
Goafie lets you follow other travelers and choose what to share with friends or publicly. Sharing is under your control and off by default for private content; you can change visibility for each trip at any time. You are responsible for what you choose to make visible to others.
7. Subscriptions and purchases
Goafie is free to download. Some features may be offered through an optional paid subscription. Subscriptions are sold and billed through the Apple App Store or Google Play and are subject to those stores' terms. Unless cancelled, subscriptions renew automatically at the then‑current price, and you can manage or cancel them in your App Store or Google Play account settings. Except where required by law or store policy, payments are non‑refundable; refund requests are handled by the applicable app store.
8. Intellectual property
The Service — including its software, design, logos, and the Goafie name and branding — is owned by us or our licensors and protected by intellectual‑property laws. These Terms do not grant you any right to use our trademarks or branding without our prior written permission.
9. Third‑party services
The Service relies on third parties — including Apple, Google, Google Firebase, and flight‑data providers — and may link to other services. We are not responsible for third‑party services, and your use of them may be governed by their own terms and policies.
10. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non‑infringement. We do not warrant that the Service will be uninterrupted or error‑free, or that travel data such as schedules, distances, delays, or statuses will be accurate or complete. Do not rely on the Service for time‑critical travel decisions; always confirm details with your airline or provider.
11. Limitation of liability
To the maximum extent permitted by law, Goafie and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or USD $50. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
12. Termination
You may stop using the Service and delete your account at any time from within the app. We may suspend or terminate your access if you violate these Terms or to protect the Service or other users. Provisions that by their nature should survive termination — including content licenses you granted, intellectual property, disclaimers, and limitation of liability — will continue to apply.
13. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you, such as posting the updated Terms with a new "Last updated" date or notifying you in the app. Your continued use of the Service after the changes take effect means you accept the revised Terms.
14. Governing law
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there, without regard to conflict‑of‑laws rules. You and Goafie agree to the exclusive jurisdiction of the courts located in Alberta, Canada — except that, where mandatory consumer‑protection law applies, you keep the right to bring a claim in the courts of the place where you live.
